The Douglas and Zeta JOnes v Hello case has been decided by the Lords this morning and it looks like there is a majority vote that Hello’s publishing their wedding pictures was a breach of confidence (per Lord Hoffmann, Baroness Hale, (there are further observations here) and Lord Brown). Lord NIcholls dissents (as does Lord Walker) that the photos are to be treated as confidential information. MOre may follow when I digest it.

This is a bloody disaster, incidentally (unless the actual judgments contain some very good back peddling.)
It’s worth speaking to Gillian about it. She went to the hearing and told me that the solicitor for Hello felt the case had been lost in the first 20 minutes of the appeal.
